INTERNET SERVICE TERMS AND CONDITIONS

Effective January 1, 2026


1. Definitions

For purposes of these Internet Service Terms and Conditions (“Terms”):

  • “Boycom,” “Company,” “we,” “us,” or “our” means Boycom Cablevision, Inc., its affiliates, officers, employees, agents, contractors, and assigns.
  • “Subscriber,” “Customer,” “you,” or “your” means the individual or legal entity that orders, receives, or uses the Service.
  • “Service” means Internet access service and any related features, support, or options provided by Boycom.
  • “Service Location” means the physical address where Service is installed.
  • “Equipment” means any modem, ONU, router, mesh device, power supply, wiring, or other hardware provided, leased, or installed by Boycom.
  • “Billing Cycle” means the recurring monthly billing period.
  • “CPNI” means Customer Proprietary Network Information as defined by applicable law.

2. Agreement and Acceptance

By ordering, activating, paying for, or using the Service, Subscriber agrees to be legally bound by:

  • these Terms,
  • Boycom’s Acceptable Use Policy,
  • Boycom’s Privacy Policy, and
  • any applicable service order or written commercial agreement.

These documents are incorporated by reference. In the event of conflict, a written commercial agreement controls, followed by a service order, and then these Terms.

Subscriber represents that they are at least eighteen (18) years of age and have the legal authority to enter into this Agreement.


3. Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to the Service, these Terms, billing, equipment, or Boycom’s practices shall be resolved through binding arbitration, and not in court, except as otherwise permitted by law.

  • Subscriber and Boycom waive the right to a jury trial.
  • Arbitration shall be conducted on an individual basis only.
  • Class actions, class arbitrations, private attorney general actions, and consolidated proceedings are expressly waived.

Subscriber may opt out of arbitration within thirty (30) days of initial service activation by providing written notice to Boycom. Small claims court actions may be permitted where allowed by law.


4. Customer Eligibility

Service is available only to individuals and entities that meet Boycom’s eligibility requirements.

Subscriber represents and warrants that:

  • they are at least eighteen (18) years of age, or a duly authorized representative of a legal entity;
  • they have the legal authority to enter into this Agreement;
  • all information provided to Boycom is accurate, complete, and current.

Boycom reserves the right to deny, suspend, or terminate Service if eligibility requirements are not met or if information provided is false, misleading, or incomplete.


5. Serviceability and Performance

Service availability depends on network facilities, geographic location, and technical feasibility.

Advertised speeds are maximum network-capable speeds and are not guaranteed between Boycom plant and the Subscriber’s Modem or ONU. Actual performance may vary due to congestion, Wi-Fi conditions, equipment, third-party networks, and factors outside Boycom’s control.

Boycom may modify, suspend, or discontinue Service as permitted by law.


6. Charges for Services; Taxes, Fees, and Surcharges

Subscriber agrees to pay all charges for Service, Equipment, installation, and related services.

Subscriber is responsible for all applicable:

  • federal, state, and local taxes
  • regulatory recovery fees
  • franchise fees
  • government-imposed surcharges

Such charges may change without notice as required by law.

7. Billing and Payment; Rate Increases

Service is billed monthly in advance.

  • Payment is due on the 1st of each month.
  • Payments not received by the 10th are late.
  • Late payment assessments apply on the 11th.
  • Returned or rejected payments incur a $25 processing fee.

Payment Timing and Responsibility

Online or electronic bill payments must be scheduled early enough to ensure payment is received by Boycom by the due date.

Subscriber is not exempt from late fees due to:

  • postal mail delays or lost checks
  • third-party bill-pay delays
  • declined AutoPay payments due to insufficient funds, expired cards, or invalid account information

Boycom may change rates, fees, or charges with notice as permitted by law. Continued use constitutes acceptance, see Section 20.


8. AutoPay Authorization and Discounts

By enrolling in automatic recurring payments (“AutoPay”), Subscriber authorizes Boycom and its payment processors to charge the designated payment method for all amounts due on the account, including recurring service charges, equipment fees, taxes, and other authorized charges.

This authorization remains in effect until revoked by Subscriber or until Service is terminated.

Subscriber remains fully responsible for all charges if an AutoPay payment fails for any reason.

Boycom offers a monthly AutoPay discount while Subscriber remains enrolled and eligible.  Subscriber is solely responsible for keeping Boycom informed of changes to payment methods, including card expiration dates or bank account changes. Loss of eligibility or failed AutoPay payments may result in removal of the discount.

Boycom also offers other credits as well for the following:  Paperless Billing, Senior Citizen, Veterans, Healthcare/First Responders, Teachers/Educators.  A maximum of two discounts is allowed per subscriber.


9. Personal Identifiers

Subscriber authorizes Boycom to collect and use personal identifiers, including Social Security Numbers, when reasonably necessary for:

  • identity verification
  • credit evaluation
  • fraud prevention
  • billing and collection activities

Such information is handled in accordance with Boycom’s Privacy Policy and applicable law.


10. Disputed Bill Charges

Subscriber must notify Boycom of any disputed charges within a reasonable time after the bill is issued.

Disputes do not relieve Subscriber of the obligation to pay undisputed amounts. Failure to timely dispute charges constitutes acceptance of the bill as rendered.


11. Credit Reporting, Deposits, and Advance Payments

Boycom may require a credit check, security deposit, or advance payment prior to providing or continuing Service.

Subscriber authorizes Boycom to:

  • report payment history to credit bureaus or collection agencies where applicable; and
  • pursue lawful collection remedies for unpaid balances.

Failure to maintain a satisfactory payment history may result in additional deposits, advance payment requirements, or termination of Service.


12. Termination of Services

Termination by Subscriber

Residential Service is month-to-month.  If Subscriber terminates Service prior to the last day of the Billing Cycle, the full monthly charge remains due with no proration or credit.

 Termination by Boycom

Boycom may suspend or terminate Service for non-payment, policy violations, fraud, abuse, or legal requirements.

 All Boycom-owned Equipment must be returned within fourteen (14) days.

13. Renewal After Cancellation

If Service is reactivated after cancellation:

  • a new service order may be required;
  • rates, promotions, and terms then in effect will apply;
  • prior pricing or promotions are not guaranteed.
  • past due balances must be paid in full for non-pay reconnection

14. Transfer of Account; Change of Residence

Service is provided solely to the Subscriber at the Service Location and is not transferable without Boycom’s prior consent.

If Subscriber changes residence:

  • Service does not automatically transfer to the new address;
  • Service availability at the new location is subject to serviceability and installation requirements;
  • a new service order may be required.

Outstanding balances must be paid in full before Service may be transferred or reestablished.

15. Equipment; Lease Fees

Unless expressly sold to Subscriber, all Equipment remains the exclusive property of Boycom. Monthly lease fees apply for Company-provided Equipment.

Risk of Loss and Misuse

Subscriber assumes all risk of loss, theft, damage, destruction, or misuse of Boycom-owned Equipment from the time of installation until return.

Subscriber shall not:

tamper with, alter, relocate, sell, or encumber Equipment;
use Equipment for unauthorized purposes or with unauthorized services.
Subscriber is responsible for replacement costs for lost, stolen, or damaged Equipment beyond normal wear.

Subscriber-Owned Equipment

Subscriber may use customer-owned equipment only if compatible with Boycom’s network.

Boycom assumes no responsibility or liability for:

  • the performance, security, or compatibility of Subscriber-owned equipment;
  • service interruptions, data loss, or damage caused by Subscriber-owned equipment.

Boycom may refuse to support or troubleshoot Service issues caused by non-approved equipment.

16. Access, Installation, Repair, and Maintenance

Subscriber grants Boycom technicians and its contractor’s permission to access the Service Location at reasonable times for installation, maintenance, repair, inspection, upgrades, or equipment recovery.

Subscriber is responsible for obtaining any re4quired permissions from landlord, property owners, or HOA approvals. Boycom is not responsible for cosmetic restoration beyond reasonable repair.  Boycom requires an authorized representative at least 18 years of age, of the subscriber be at premises before technicians can enter.

17. Seasonal Hold / Vacation Mode (Seasonal Saver Plan)

Boycom may offer a Seasonal Saver Plan allowing temporary reduction of Service:

  • Reduced-speed Service (3 Mbps / 1 Mbps)
  • Up to six (6) months per twelve (12) month period
  • Essential connectivity maintained
  • Equipment remains installed

Availability, pricing, and scheduling are subject to Boycom approval.

18. Privacy and Customer Proprietary Network Information (CPNI)

Boycom collects and protects customer information consistent with its Privacy Policy and applicable law.

  • Only diagnostic and operational network data is retained
  • Browsing content is not monitored
  • Customer data is not sold or shared for marketing

CPNI is protected and disclosed only as permitted by law.

19. Disputed Bill Charges

Subscriber must notify Boycom of disputed charges within 30 days of bill date.

Disputes do not relieve Subscriber of the obligation to pay undisputed amounts. Failure to not contact Boycom within the 30 days constitutes acceptance of charges on the bill.

20. Copyright Infringement Policy

Boycom respects intellectual property rights and complies with applicable copyright laws, including the Digital Millennium Copyright Act (“DMCA”).

Boycom may, upon receipt of valid copyright infringement notices:

  • forward notices to Subscriber;
  • suspend or terminate Service for repeated or egregious infringement; and
  • take other actions as required or permitted by law.

Subscribers are responsible for ensuring that their use of the Service does not infringe upon the intellectual property rights of others.

21. Theft and Fraud

Subscriber shall not engage in theft of service, fraud, unauthorized access, or other unlawful use of the Service or Equipment.

Boycom may immediately suspend or terminate Service and pursue civil or criminal remedies as permitted by law.

22. Changes in Service, Charges, or Terms

 Boycom may, as permitted by law:

  • modify Service features, speeds, or technical specifications;
  • eliminate services
  • change rates, fees, surcharges, or billing practices; or
  • amend these Terms, the Acceptable Use Policy, or the Privacy Policy.

Boycom will give Subscriber 30 days’ notice of:

  • increases or other changes in charges;
  • changes to or elimination of Services.

Notice of changes or elimination may be provided through billing statements, account notices, email, website postings, or other reasonable means. Continued use of the Service after the effective date of a change constitutes acceptance.

23. Limitation of Liability

To the fullest extent permitted by law, Boycom is not liable for indirect, incidental, punitive, or consequential damages, including loss of data or profits.

24. Governing Law

These Terms are governed by the laws of the State of Missouri and applicable federal law.
